U.S. government: AVX has no basis for pollution appeal By David Wren Myrtle Beach Sun-News (SC) April 17, 2012While AVX Corp. doesn't agree with a federal judge's order stating that the company is responsible for cleaning up all of the groundwater pollution on neighboring property in Myrtle Beach, the electronic components manufacturer hasn't presented any evidence that Judge Terry Wooten erred in his ruling last year, according to court documents filed this week by the federal government.
The documents were filed in response to AVX's request in February for a new trial in an environmental contamination lawsuit that dates to 2007. The request is being considered by the Fourth Circuit Court of Appeals in Richmond, Va.
In its response, the federal government says AVX has not stated any valid reason that a new trial should be granted.
