Army Challenging Improved Soil Testing Requirements

The U.S. Army is challenging a directive from the Wisconsin Department of Natural Resources (WDNR) to expand testing of contaminated areas at Badger Army Ammunition Plant. The WDNR recently asked the military to start testing soils for all six forms of the carcinogenic explosive DNT. (Right now, the military only tests for two.) The improved testing could lead to stronger cleanup requirements for the military at Badger and – if other states follow Wisconsin’s leadership – better cleanup at other military sites across the country.

In response, the Army has submitted a formal letter questioning the WDNR’s authority to require the expanded testing. In their October 11 letter to the WDNR, Army officials wrote: “At this time, given the absence of a clearly identified legal obligation to comply with the soil sampling currently sought, the Army does not intend to conduct the additional sampling for all six isomers of DNT.”
