Court rules against Army in Makua case By Gregg K. Kakesako Honolulu Star-Bulletin November 19, 2009U.S. District Chief Judge Susan Oki Mollway has sided with Hawaiian activists, who want the Army to stop training in Makua Military Reservation, and ordered the military to provide more information on how training could damage cultural sites in the Leeward Oahu valley and possibly contaminate marine resources used by area residents.
In August, the Army filed a motion seeking to dismiss a complaint by Malama Makua, a community organization that has been arguing against continual use of the valley which some Hawaiians believe is sacred.
Maelama Maekua, represented by Earthjustice, had asked the court to set aside the Army's environmental impact statement for proposed military training at Makua until it completes more marine contamination studies and archaeological surveys.
