Travis land-use ruling
Court eases development restrictions

A protection plan for land use around Travis Air Force Base has been
ordered by a state appellate court to be set aside, putting a question
mark over what kind of development will be allowed near the air base in
the future.

The State Court of Appeal, First Appellate District, this week
overturned an earlier ruling by the Solano County Superior Court that
rejected a suit by Muzzy Ranch Co. in 2002.

The appellate court ruling compels the lower court to issue a writ
ordering the Solano County Airport Land Use Commission set aside its
adoption of the 2002 Travis Air Force Base Land Use Compatibility Plan.

The suit contests the plan completed by the land use commission puts
restrictions on sprawling areas of land around the air base.

The suit also alleges that the land-use commission used a broad
authority in limiting where development would be allowed in the county's
unincorporated areas, including the 5,000-acre Muzzy Ranch holding.
