Bear in mind the eastern transfer provision is not yet law.  So, before 
you look to judicial solutions, start with Congress.  There is a lot of 
opposition to this provision which has a long way to go before it is 
passed by both houses.  Congressional members need to be educated on its 
pitfalls.
