The township will not be hit with a violation notice following the unearthing earlier this month of a former landfill that sits under a park, a state Department of Environmental Protection spokesman said. The incident in John F. Johnson Memorial Park occurred Oct. 12, when a paving company began work on a $455,000 contract to build two basketball courts in the park. "Through an oversight, they hit garbage, and they took corrective action to cover it back up," DEP spokesman Larry Hajna said Monday. He acknowledged that state law requires written approval from the DEP before work may be done on a landfill site, and that Jackson did not seek such approval before starting the project. When asked why that was not deemed a violation, he said it was the inspector's decision, based on the township's promise to apply for the necessary approvals.
