Subject: [CPEO-MEF] PERCHLORATE: Lawsuit against Chilean fertilizer supplier
Lindsay suing fertilizer company for tainted well

Porterville Recorder (CA)
June 20, 2011

The City of Lindsay is suing a Chilean fertilizer company and its North American subsidiary for their role in allegedly contaminating one of the city's key groundwater wells.

Todd Robins, who is representing the city, is claiming that local citrus farmers' historical use of a nitrate-based fertilizer, manufactured by Sociedad Quimica y Minera de Chile and imported into the U.S., contaminated Well 11 in Lindsay with toxic perchlorate.

Robins, a partner with Sher Leff in San Francisco, said perchlorate, a salt that is derived from perchloric acid, is "an unnecessary, extra ingredient" in the fertilizer that was used by local farmers.

"The perchlorate doesn't contribute to the effectiveness of the fertilizer," Robins said.
