Supreme Court accepts Atlantic Research Superfund appeal By Mark H. Anderson MarketWatch January 19, 2007WASHINGTON (MarketWatch) -- The U.S. Supreme Court Friday said it will wade again into liability-sharing issues surrounding voluntary cleanups at Superfund environmental sites, agreeing to hear a case involving a unit of GenCorp Inc. (GY).
The high court's acceptance of the case marks the second time in three years that it has dealt with Superfund cost-sharing issues. In the new appeal, the justices will decide whether a company doing contract work for the U.S. military can seek financial help from the government when it voluntarily cleans up a Superfund site.
The case deals with the cleanup of perchlorate rocket propellant contamination at an industrial park in Camden, Ark., by Atlantic Research Corp., which has since been purchased by Aerojet, a GenCorp unit. Atlantic Research wants the government's help in covering the cleanup, which involved the removal of contamination from burnt rocket fuel in both the soil and groundwater at the industrial site.
