Pentagon sues Colorado over new state asbestos rules

PUEBLO, Colo. (AP) — The Defense Department has sued Colorado over new state asbestos rules that Army officials say could dramatically increase costs for a planned $2 billion expansion at Fort Carson.

The rules, enacted in April, could force Congress to reconsider where it spends military construction dollars, Senate staffers said after a briefing Wednesday.

The government's suit was filed Tuesday in U.S. District Court in Denver. It argues the state Board of Health went too far by requiring that Colorado businesses and military posts test for soil contamination at construction and demolition sites.

The rules say soil tainted with asbestos must be taken to designated landfills.
