RALEIGH The Navy on Tuesday said it was encouraged by a federal appeals
court ruling that allowed planning and property purchases for a jet
landing field in eastern North Carolina, but opponents said the legal
fight isn't over.

The Navy and opponents of the field still must meet in federal court
Jan. 19 to argue their positions and wait for the judge to make a final
decision on the field.

The 4th U.S. Circuit Court of Appeals in Richmond, Va., issued a
one-sentence ruling Monday that lifted the preliminary injunction issued
by U.S. District Court Judge Terrence Boyle. The order stopped all work
by the Navy on the proposed Outlying Landing Field, or OLF, in
Washington and Beaufort counties.

Opponents of the field, including environmental groups and the
governments of both counties, sued the Navy in an attempt to stop
development of the field. Opponents said the OLF would endanger birds
from a nearby wildlife refuge and take farm land that had been in
families for generations.
