Judge blocks Hanford initiative

By Annette Cary Tri-City Herald (WA) December 3, 2004

YAKIMA -- A federal judge ordered a temporary stop to the enforcement of Initiative 297 on Thursday, averting a threatened halt of cleanup at Hanford and research at Pacific Northwest National Laboratory.

However, Federal Judge Alan McDonald ruled that the temporary restraining order would not extend to a key portion of the initiative. The Department of Energy is not allowed to start bringing radioactive waste to the Hanford site, an issue already addressed in a pending suit brought by the state in 2003.

Voters in every county of the state but Benton and Franklin counties voted Nov. 2 to stop DOE from bringing more waste to Hanford until the waste already there is cleaned up.

The U.S. government raised serious questions concerning the validity of the initiative, McDonald found Thursday.
