It's publicly available through FOIA procedures, but only if you pretty much know what you are looking for. If you submit a request for "reports" in general, you won't get anything. If you ask for the file relative to a particular site, you can get whatever is in the file. If you don't know what file you are looking for (not necessarily a tax parcel ID) you won't necessarily find anything.

I just got a BFPP letter from the Virginia DEQ for a site. We sent in the Phase I and the Phase II and they responded with a letter. How else would you document your status as a BFPP? I've had other clients (generally prospective purchasers) who want the State to read the report and tell them there's no issue with "whatever" before they continue. Those reports are all in the State files. From talking to colleagues in other areas, I believe other States do the same thing. Jerry. -------------------------------------------- W.
