In response to Sam:

Where institutional controls are approved in lieu of treatment, they
are part of the remedy. Responsible parties are supposed to pay for
those controls, and I see no problem with states charging them up front
for listing those controls in statewide registries. After all, by
accepting such controls, state regulators are making life easier for
the responsble parties.
